New California Driving Laws Start Jan. 1

The new year brings new driving regulations to the Golden State.

For most of us, it's been a long time since we were forced to take a driving test — written or behind the wheel. And while we like to believe we are still competent in the driver's seat, a lot has changed since the time we were issued a license.

Every year, new driving laws go into effect. Jan. 1, 2013 will bring a new set of regulations that are important to know.

“The changes to California’s traffic safety laws are designed to protect the motoring public,” said CHP Commissioner Joe Farrow.  “Citizens are encouraged to familiarize themselves with these new laws in advance of the new year. Adhering to the rules of the road may save your life, or the lives of your fellow motorists.”

The following is a list of updates to California laws that all drivers should take into account. 

  • AB 2020: A person arrested for suspected DUI will no longer be given the option of a urine test. In previous years, the option was given of either a urine test of a blood test.
  • AB 45: Bus and limousine drivers will be held responsible for telling all underage passengers that drinking alcohol is illegal. If alcohol is being transported in a bus or limousine with underage passengers on board, a person at least 25-years-old must be on board to ensure there is no underage consumption.
  • AB 1536: It will be legal to send and receive text messages with hands-free devices powered by voice-operated software. 
  • AB 1708: Drivers will have the right to show proof of insurance and registration on a smartphone or tablet when pulled over. 
  • AB 2405: Cars with Clean Air Vehicle stickers will be allowed to use High Occupancy Toll lanes. 
  • SB 1298: Self-driving cars will be allowed on public roads for testing purposes as long as a licensed driver is in the driver's seat. 
  • SB 1047: CHP will begin a Silver Alert system similar to Amber Alert, but for missing people over 65-years-old.

AB1708 allows drivers to show insurance via smartphone, but NOT registration.

I like the idea of AB 1708 where the driver can show his auto registration and proof of insurance on either an iPad or a smartphone. They should have extended it to allowing one to put their driver's license on it as well. The only downside about putting your registration and insurance card on your smartphone is you had better remember to update the pictures when your annual/semi-annual renewals comes up.

I am always amazed how much you folks love more controls on your life. Can't you do the right thing without the government telling you what to do?
These government incompetents can't balance a budget. What makes you think they know best?

It's about time they eliminated the option for a urine test with DUI suspects! What a PITA that was.

We need rules. People are generally irrational. I don't trust anybody on the road except myself. The other day I saw 6 different accidents. Stupid people should not drive.

It is illegal to talk or text on your phone without a hands free device, where's the law which makes it illegal to cross the street, even at a controlled intersection, doing the same! Some idiots just don't have a clue, therefore don't pay attention to where they are driving or walking!

None of these new laws will make any of us safer. What will is enforcing the DUI and unlicensed drivers laws. The DUI laws are treated about as seriously as parking tickets (except you can get out of a DUI but not a parking ticket). The unlicensed driving laws are completely ignored by almost the entire state.

I feel that splitting lanes, by motorcyclists, should be illegal. They should follow the same road rules as people driving cars. It can be startling to suddenly have a motorcyclist zoom past in stop and go traffic and when changing lanes.

I do not like the idea of having too much of your personal information on a phone or tablet, we already have to worry about cyber thieves. Plus if you have a folder in your car then you can keep all your paperwork in there. My car came with a folder and that is what I use it for, all my current paperwork, car manual, etc. It's much easier and faster to find than on an electronic device.

Most motorcycles are air cooled meaning you need to have air constantly running through the engine at a fairly rapid rate while the engine is running. If you don't, your engine will overheat and seize up. While SOME riders split lanes just to get ahead even while traffic is moving well, MOST of us do it in a responsible manner and for the reason I stated.

None of the laws stated above will make us any safer. These new laws were made to transfer liability and clearly establish fault or closing bureocracy loopholes.

I like the Silver Amber alert. I'm a tweeter and when I see something like that I tweet out. Also one time got a message on my phone to BOL for a Senior one time.
But I think they should enforce the laws on the books already! Stop for peds in crosswalk,Enforce the speed law! A law I'd like to see banished is R turn on red. The courts are shutting down more I see. I have a court right down the street but have to send something all the way to RWC to get it filed. Oh filing fee $20.! Ripoff. Our courts are just a huge moneymaking biz. Its ridiculous that I can't get things done at my court down the street. Less hours, more money, less service. Ya that's the way to improve stuff. <eyeroll>

Have you? They need to implement the law already on the books. What's its been a law not to talk on the phone for what 1-2 years now? Yet every morning trying to cross the street I can count on my hands the drivers on the phone!
And Carole, "you are not thinking folks" who are you talking too? Not us I hope b/c we don't make the laws. I hope you contact your assemblyman and let him know your view. But sometimes I wish I could enforce the law. If I could write tickets I could bring in alot of money lol. No one hardly, obeys the laws. 9 of of 10. I can stand waiting to cross and ONE out of 10 people will stop and obey the law. One day I'm taking my camera and giving the film to Patch :) to give to police. :)

Carole, blame the lawyers. It should be easy enough to have a law that states something like "you will drive safely at all times.", but lawyers obliterated the concept of simplicity by saying such laws are not specific enough to enforce. Funny how that makes more work for the...lawyers.

Right on Wolf! All these people complain that the cops give tickets just to get money for the city. I'm fine with that! I wish they would hire additional officers just to enforce traffic laws...and up the penalties to the point people would stop driving so recklessly.

To help make our roads safer they need to do their jobs. Not putting someone in jail for driving with NO DL or suspended or revoked DL sends a message of "oh well, no big deal." These people have NO DL for a reason and should not be on the road as a driver. When charges are plead down and dropped the message is the same, no big deal. If you are endangering others lives and well being it neeeds to be taken seriously. The penalties need to fit the crime, no more slap on the wrist. Too many have been previously stopped for a violation revoked, suspended or no DL at all, only to be "warned" and let go with no impound of car etc. Then days weeks or months later someone is killed. It's way over due serious changes need to be made.

Please, may we have a law of passing only on the left & slower vehicles MOVE over & stay to the right, as in Europe; & teach conscientious driving with respect to those around you.

Try looking at California V C Section 21750 Overtake and Pass to Left, it's already on the books. Not observed or overused but it's been there for years. We have too many rules, regulations, and laws that are not observed. We don't need more.
