Preliminary Hearing for Homicide Case Reset

A judge granted a motion from the defense attorneys to continue the case, but not without a warning.

The preliminary hearing that was scheduled today for the Cypress Avenue murder case has been delayed after the defense attorneys asked a judge for more time, the San Mateo County District Attorney's office said.

San Mateo County Superior Court Judge John Grandsaert on Thursday granted the motion to continue the hearing to Dec. 9, but he warned the defense attorneys that there would be no more delays in the case, according to the district attorney's office.

The case against Nicholas Vargas, 25, of San Bruno and Brandon Thompson, 26, of San Mateo has been delayed numerous times since the April 10 homicide of 23-year-old Christopher Chastain. Vargas and Thompson are accused of killing Chastain after a late-night argument at Vargas’s parent’s house on Cypress Avenue went horribly wrong.

Both assailants have remained in San Mateo County Jail without bail since they were arrested shortly after the homicide.
