Prison for Man Who Stole Gloves, Belt from Sears

The petty theft was the man's third strike, but a judge decided that the crime wasn't harsh enough to send him to prison for life.

A man who stole a pair of gloves and a belt from Sears avoided his third strike but will still serve time in prison, a judge ruled last week.

Emmanuel Isaiah Williams, 32, was arrested on Dec. 13, 2010, after being seen shoplifting from the store.

A jury convicted Williams of felony theft after a three-day trial in January. He had been convicted of two previous felonies, and the Sears theft would have been his third strike, which means he would have to serve life in prison.

But San Mateo County Superior Court Judge Gerald Buchwald decided to strike Williams' most recent charge off his record.

Instead, he will serve 32 months in state prison, said District Attorney Steve Wagstaffe.
